New duties for online traders to provide information
The main aim of the ODR regulation is to create an online dispute resolution platform (ODR platform) at EU level. The ODR platform is intended to create a point of contact for consumers and traders seeking to resolve disputes out of court that have arisen from online transactions. For this purpose, complaints should be passed on via the platform to the national mediating body responsible for the relevant dispute. Offline contracts are not covered by this regulation.
In its judgment dated 12 May 1998, the Regional Court of Hamburg ruled that joint responsibility for the content of a linked site may also lie with the party who sets up the link.
